Membership
Naavi has been managing CEAC services since around 2002.
Since then the requirement of the CEAC services has grown. CEAC has therefore proposed to expand its activities
by becoming a service provider to other professionals through a
membership scheme.
Members of CEAC services will be provided the back
end support to deliver services to their customers using the services
offered by CEAC.
Interested professionals may contact Naavi with a
request for membership indicating the areas of their interest and their
proposed business plan.
It is proposed that a network of CEAC professionals
is created across India who would provide various services using the
backend support provided by CEAC.
The main service provided by CEAC associates would
relate to "Archival" of electronic documents for rendering them
admissible in a Court of law. This service will be mainly delivered by
legal professionals as part of the litigation assistance they may
provide to their clients. They may also provide Cyber law related
consultancy to victims of cyber crime and also the Police as and when
required.
Those of the associates who would like to utilize
other related services of CEAC may use such services as per terms elated
thereto.
In due course the network is expected to develop an all
India ODR network and assist in the promotion of Arbitration and
Mediation through virtual interactions.
Types of Membership
There will be two kinds of memberships. Primary
membership which is free and where the member will function as an
associate of CEAC while the services are mainly rendered by the central
office. Golden members would be delivering part of the service locally.
Archival Services through the membership network:
Purpose:
The members of CEAC will act as associates of CEAC
and provide archival services in the place where they are located.
Primary members will direct the requirements of CEAC certification to
the CEAC central office which will directly provide the certification.
The local associate will provide support when called for to provide
evidence in the local Court.
Golden members may certify
electronic documents themselves which are archived with CEAC for the
purpose of admissibility as per Section 65B of ITA 2000 and file a copy
of the certificate with the central office of CEAC.
CEAC will maintain a centralized archival register
for all certified documents as per procedure to be laid down. Procedure
for certification and the template for certification will be provided by
CEAC.
Criteria:
Members who are desirous of acting as associates of
CEAC as primary members may register with CEAC for approval. There is no
membership fee for primary membership. Membership will at the sole
discretion of CEAC which shall retain the right to refuse any
application without assigning any reason thereof.
Primary members with necessary experience may be
upgraded as Golden members upon satisfaction of CEAC and payment of a
registration fee of Rs 1000/- (Subject to change) for the first member
in a town/city. Subsequent members in a city shall be enrolled at a
higher registration fee.
Golden membership will be provided only upon
completion of at least two CEAC assignments as a primary member.
Revenue Sharing
Associates who are Primary members would be receiving
a revenue share of 40% from the CEAC fee generated. If any Court
appearance fee is collected where the associate has to appear in a Court
for the purpose of representing CEAC, 80% of the fee collected for the
purpose will be paid to the associate.
Associates who are Golden members will have the
option of either forwarding the certification request to CEAC in which
case they will also share the revenue as above. If however they provide
their own certification then 60% of the revenue would be payable to the
associate. The Court appearance fee if any will be shared as in the case
of Primary members.
Procedure
Persons desirous of enrolling as members may send
their CV to CEAC with a request for membership. After scrutiny CEAC will
send a copy of an associate agreement to be executed. Upon execution of
the agreement, a person will be enrolled as a "Primary Member". Upon
completion of the minimum two assignments as a Primary Member, the
associate may apply for upgradation of membership. On confirmation from
CEAC the necessary fee may be paid and a supplementary agreement
completed for upgradation.
Termination
Membership may be terminated by mutual consent at any
time. Registration fee paid if any will be refunded only when a member
is terminated at the instance of CEAC.

ODR Services through the membership network:

is available at www.odrglobal.in Gold Members of CEAC may avail co-membership
of arbitration. in at a concessional membership fee of Rs 1000/-
only.

Other CEAC
Services through the membership network:
CEAC
members may refer any other CEAC service on behalf of their clients to
the CEAC Central office.
The
general revenue sharing principle is that in all instances where the
service is referred, the associate will be paid 20% of the revenue
generated as referral fee and 80% of the fee related directly to
services rendered by the associate himself.

In the long run, it is expected that CEAC may invite funding bodies to
invest in the venture. In such an event all the associates will be
collectively offered a benefit as may be negotiated with the investor
which will be proportionately shared with different associates based on
the business generated by them until then. At this point of time however
no firm offer of any sort is offered.
